CJEU ruling invalidates consent in pre-ticked boxes with Orange Romania

On 11 November 2020, the Court of Justice of the EU adopted a ruling which considers that Orange Romania did not comply with 95/46/EC Directive on personal data protection (and with the GDPR) when pre-ticking a consent box which authorised the company to store ID information aside the signature of telecom contracts.  The Court states that using a pre-ticked box is not a valid consent and does not fulfil the requirement of active and effective consent from the user.
