With effect from December 1st, 2021, two laws came into force in Germany that define the legal basis for the publishers of subscriber directories and the providers of directory assistance services and have replaced the regulations of the old german Telecommunication law:
– The law on data protection and privacy protection regulations in telecommunications and telemedia (TTDSG) and
– the law for the modernization of telecommunications law (TkMoG), which implements the directive of the EU telecommunications code in national German law.
While the TTDSG has more or less taken over the regulations of the old Telecommunication law without even rudimentarily taking into account the changed technical framework conditions as well as the services such as WhatsApp and their effects that have come onto the market in recent years, the TkMoG contains a clear political devaluation of subscriber directories, which are no longer defined as a universal service.
